The alleged prostitute accused of threatening to blackmail the former president of the Pennsylvania Bar with a sex tape she secretly recorded intends to plead guilty in the case, her lawyer said in court on Wednesday.
Emily Ann Merth, 26, faces a felony charge of attempted theft by extortion, alleging that she secretly recorded herself having sex with lawyer David Eric Schwager and threatened to ” post the video everywhere “if he didn’t pay her $ 1,000.
In court on Tuesday, defense attorney Joseph James Grochal said Merth was in talks with prosecutors, who had previously withdrawn prostitution charges against her.
Luzerne County Judge Joseph F. Sklarosky Jr. continued Merth’s adjudication hearing until Dec. 2 and agreed to reduce his bond from $ 25,000 to $ 10,000 unsecured.
Merth, who appeared on video, will therefore be released from Lehigh County Jail, where she recently served her sentence on two unrelated prostitution charges.
Merth is also out on bail in a separate case as she awaits trial for theft and burglary in York County.
Schwager, 58, of Kingston, is serving 12 months in the accelerated rehabilitation program on a misdemeanor charge of condescending prostitutes resulting from his meeting with Merth.
